Terms of Use (EULA)

1. Introduction

Welcome to WellBee (“WellBee”, “we”, “our”, or “us”). These Terms of Service (“Terms”) govern your use of the WellBee mobile application and any related services we provide.

By downloading, accessing, or using WellBee, you agree to be bound by these Terms. If you do not agree with these Terms, you should not use the app.

2. Eligibility

You may only use WellBee if you are legally able to enter into a binding agreement under the laws of your country.

If you are under the age required to enter into such an agreement, you must have permission from a parent or legal guardian.

3. Description of WellBee

WellBee is a personal health diary designed to help users organise and record aspects of their health and wellbeing.

Features may include:

  • Medication tracking
  • Medication schedules and reminders
  • Health diary entries
  • Symptom and temperature logging
  • Health record management
  • Injury and diagnosis tracking
  • Other health-related organisational tools

WellBee is intended to help users organise their personal health information. It is not intended to replace professional healthcare.

4. Medical Disclaimer

WellBee is not a medical device and does not provide medical advice. Information displayed within WellBee is provided solely from information entered by you and is intended for personal organisational purposes only.

WellBee does not:

  • Diagnose medical conditions
  • Recommend treatments
  • Offer medication dosage guidelines
  • Replace healthcare professionals
  • Monitor your health in real time
  • Contact emergency services

Always seek the advice of a qualified healthcare professional regarding any medical concerns. Never delay seeking medical advice because of information contained within WellBee.

If you believe you are experiencing a medical emergency, contact your local emergency services immediately.

You should independently verify all medication names, dosages, schedules and other health information before acting upon them.

5. Reminders and Scheduled Events

WellBee may provide notifications for reminders or other types of scheduled events that you configure. While we aim to provide reliable and timely notifications, we cannot guarantee that notifications will always be delivered.

Notifications may fail or be delayed due to factors outside our control, including but not limited to:

  • Device settings
  • Notification permissions
  • Operating system behaviour
  • Battery-saving features
  • Network conditions
  • Software issues

You remain solely responsible for adhering to treatment plans offered by a health care professional or taking medications correctly and at the appropriate times.

6. User Responsibilities

You are responsible for:

  • Entering accurate information into WellBee.
  • Keeping your device secure and protected.
  • Reviewing information before relying on it.
  • Maintaining any records you consider important.

You acknowledge that WellBee relies on information provided by you and that incorrect or incomplete data may result in inaccurate reminders or records.

7. User Content

You retain ownership of all information, records, and other content you enter into WellBee (“User Content”). You are solely responsible for the accuracy, completeness, and legality of your User Content.

You grant us only the rights necessary to store, process, and display your User Content for the purpose of operating WellBee. We do not claim ownership of your User Content.

8. Local Data Storage

At the time these Terms take effect, WellBee stores your information locally on your device. You are responsible for safeguarding your device and any backups that may be available to you.

If you uninstall the app, erase your device, or otherwise remove your locally stored data without first creating a backup (where available), your information may be permanently lost.

Except where required by law, we are not responsible for the loss of locally stored data.

9. Premium Subscription

  • Certain features of WellBee may require a Premium subscription.
  • Premium subscriptions are offered as automatically renewing monthly or yearly subscriptions.
  • Payment is processed by Apple through your Apple ID.
  • Subscriptions automatically renew unless cancelled before the end of the current billing period.
  • You can manage or cancel your subscription through your Apple account settings or in the WellBee app.
  • Refunds are handled in accordance with Apple’s policies and applicable law.
  • Premium features may change over time as WellBee evolves. We may add, modify, or remove Premium features, provided we comply with applicable law and honour our obligations to existing subscribers.

10. Licence

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use WellBee solely for your personal, non-commercial use.

This licence does not transfer ownership of the app or any intellectual property.

11. Acceptable Use

You agree not to:

  • Copy or redistribute the app.
  • Reverse engineer, decompile or attempt to extract the source code.
  • Circumvent or attempt to bypass Premium features.
  • Use the app for unlawful purposes.
  • Interfere with the operation or security of the app.
  • Misrepresent your identity or ownership of content.

12. Intellectual Property

WellBee, including its design, branding, graphics, logos, software, text, icons and other content, is owned by us or our licensors and is protected by applicable intellectual property laws.

Except as expressly permitted in these Terms, no rights are granted to you.

13. Privacy

Your use of WellBee is also governed by our Privacy Policy. The Privacy Policy explains what information is collected, how it is used, and your rights regarding your information.

By using WellBee, you acknowledge that we process your information in accordance with our Privacy Policy.

14. Availability

We aim to provide a reliable service but do not guarantee that WellBee will always be available or operate without interruption.

We may:

  • Update the app.
  • Add or remove features.
  • Fix bugs.
  • Perform maintenance.
  • Modify functionality.
  • Temporary interruptions may occur.

We also reserve the right to suspend, withdraw, or discontinue any part of WellBee at any time where reasonably necessary.

15. Limitation of Liability and Disclaimer of Warranties

To the fullest extent permitted by law, WellBee is provided on an “as is” and “as available” basis. We make no warranties or representations, whether express or implied, regarding the operation, availability, reliability, accuracy, security, or suitability of WellBee for any particular purpose.

We do not warrant that the app will be uninterrupted, error-free, free from defects, or that notifications or scheduled events will always be delivered successfully.

To the fullest extent permitted by law, we shall not be liable for:

  • Missed reminders, notifications, or scheduled events.
  • Loss of data.
  • Health outcomes.
  • Loss of profits.
  • Indirect, incidental, special, or consequential losses or damages.
  • Decisions made based upon information contained within the app.
  • Nothing in these Terms excludes or limits liability where such exclusion or limitation would be unlawful.

16. Indemnity

You agree to indemnify and hold us harmless from any claims, damages, liabilities, losses, and expenses arising from your misuse of WellBee or your breach of these Terms.

17. Termination

You may stop using WellBee at any time.

We may suspend or terminate access where reasonably necessary, including where you violate these Terms or misuse the app. Termination does not affect any rights or obligations that arose before termination.

18. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of England and Wales, unless applicable consumer protection laws in your country require otherwise.

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where local law provides otherwise.

20. Apple App Store Terms

If you downloaded WellBee through the Apple App Store:

  • Apple is not responsible for the app or its content.
  • Apple has no obligation to provide maintenance or support services.
  • Apple is not responsible for addressing claims relating to the app except where required by law.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them where applicable.

21. Third-Party Services

WellBee relies on services provided by third parties, including Apple, to provide functionality such as purchases, notifications, and app distribution.

The availability, performance, and operation of these third-party services are outside our control and may be subject to their own terms and policies. We are not responsible for interruptions, delays, or failures caused by third-party services.

22. Changes to These Terms

We may update these Terms from time to time. Where changes are significant, we may notify users within the app or by other appropriate means. Continued use of WellBee after updated Terms become effective constitutes acceptance of the revised Terms.

23. Feedback

If you choose to provide suggestions, ideas, feature requests, or other feedback relating to WellBee, you agree that we may use, modify, implement, and incorporate that feedback without restriction and without any obligation to compensate you.

24. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

25. Assignment

We may transfer or assign our rights and obligations under these Terms in connection with a merger, acquisition, sale of assets, or by operation of law. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

26. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WellBee regarding your use of the app and supersede any prior agreements relating to its use.
